How Insurance Companies Value a Connecticut Personal Injury Claim

There is no one-size-fits-all formula for determining the value of your Connecticut personal injury claim. The amount of compensation you may be entitled to depends on your injuries, how the accident occurred, any time you missed from work and many other factors.

An insurance company will place a value on a claim by first assessing how much money you have spent or lost as a result of your injuries. These are considered monetary damages. Nonmonetary damages, such as physical and emotional pain, are difficult to value.

To put a value on nonmonetary damages, an insurance adjuster will usually add up your medical expenses, which are called special damages. The adjuster will use this figure to calculate your general damages, which are nonmonetary damages.

If your injuries are minor, the insurance adjuster might double your special damages. If your injuries are severe and the pain is excruciating, the insurance adjuster might multiply your special damages by as much as 10.

Damages for lost wages will be added and then the insurance company will have a figure around which to begin negotiations.

It would be in your best interest to have a Connecticut personal injury lawyer handle these complex negotiations. A lawyer can help you seek any and all compensation you may be entitled to recover. Additionally, if your insurance company refuses to present you with a fair settlement, your lawyer will be prepared to take action in court on your behalf.

To learn more about determining the value of a personal injury claim, visit our article library.

Contacting a Connecticut Personal Injury Lawyer

A Connecticut personal injury lawyer can help you maximize the value of your personal injury claim.

What is a Connecticut personal injury claim? - It is a claim filed with an insurance company to recover damages (compensation) from an accident that is caused by another's negligence in order to pay for the expenses caused by your accident injuries.

Where do I file my Connecticut personal injury claim? - You will typically file your claim with your own insurance company, but the best course of action is to take your case to a Connecticut personal injury lawyer to determine all liable parties.

When should I file a Connecticut personal injury claim? - As soon as possible! The longer you wait to file, the higher the risk that your evidence could be lost or destroyed. The Connecticut statute of limitations also only allows for up to 2 years after your accident for you to file a claim.

Who can file a Connecticut personal injury claim? - Anyone who has suffered injury due to the negligence of another party.

A national grant program may have an impact right here in Connecticut. The Students Taking Action for Road Safety Act of 2010 (STARS) has been presented to the House of Representatives. The large bill, totaling $25 million per year, would fund programs here in Conn. and across the nation.

The goal of the bill is to increase awareness of safe driving among high school students. As we have discussed before, driver distraction, due primarily to passengers and electronic devices, are common among teens and young adults and a major cause of serious accidents.

The bill's supporters hope to boost support for student-led groups that work to promote teen safety programs. National and state teen safety driver conferences would also be held, along with outreach programs that target parents of teen drivers.

The question is: Will the bill work to prevent teen driver distraction? Though we are hopeful, the only thing we can be sure of is that good driving starts at home. You, as the parent of a teen, are the best deterrent of distracted driving. Leading by example, put down the phone and drive. Also, establish basic safe driving guidelines and talk often about the importance of safe driving.

Whether or not the bill passes, we can work, at a local level, to keep our teens safe. Join our law firm today in our effort to spread the word about the dangers of texting and driving, talking and driving and other dangerous distracted driving behaviors.

Connecticut is famous for our beautiful fall foliage. The state boasts several National Scenic Byways. These roads, such as Conn. State Route 169 and the Merritt Parkway (SR 15) draw drivers and bikers from across the nation. However, all this attention and traffic, combined with driving hazards unique to season, can create dangerous driving conditions.

For example, driving on leaf covered roads, especially when it has been raining, can cause your car to lose traction, possibly causing an accident. In addition, leaves can cover road defects such as pot holes, making it nearly impossible for you to avoid them. This can be particularly dangerous for motorcyclists.

In addition, the fall light can make windshield glare more apparent. Many people choose to take a scenic drive at sunset, so be sure to pull over in a safe location if you are having a hard time seeing. Morning frost on both windshields and roadways are a real possibility this time of year. Clear all leaves and frost from your windows and windshield before hitting the road.

At Glass, Lebovitz, Kasheta & Bren our staff and attorneys would like you help you stay safe. This fall, and every day, please remain aware of your surroundings and focus on the road, taking into account any and all seasonal hazards.
